Terms of Service

These Terms govern the use of Babooma: the website, the web app, the API and the shop modules (the "Service"). By creating an account you accept them.

1. The Service

Babooma turns your product information (a product link, photos, texts) into short videos with an AI presenter, voice and captions, and a text for publishing.

2. Who provides it

• Payments in Ukrainian hryvnia: ФОП Омельченко Денис Петрович (tax number 3224021452), Ukraine.
• Payments in other currencies and use without payment: Dowell LLC, Florida, USA.

"We" means the seller of your order. Contact: [email protected].

3. Your account and your content

• You must be 18 or older, give correct information and keep your sign-in secure. The workspace owner manages members and payments.
• You keep all rights to what you upload and confirm you may use it. You are responsible for the facts about your product (price, specifications, claims). Review every video before you publish it.
• You may create a presenter from a photo of a real person only if it is you or you have that person's written consent: see Likeness Consent. Photos of children and public figures are not accepted.
• Follow the Acceptable Use Policy.

4. Credits and payment

• The Service is paid with credits: one credit is one video. Prices are shown in the app at checkout.
• Package credits are valid for 12 months, promo credits for 30 days. We remind you before they expire.
• A credit is reserved when you start a video and spent when the video is ready. If generation fails on our side, the credit returns automatically.
• Credits are not money and cannot be exchanged or moved to another workspace.
• By starting a video you ask us to perform the service immediately; for credits already used the right of withdrawal ends. Refunds: Refund Policy.
• Card payments are processed by a payment provider; we do not store card details. Companies may pay by invoice.

5. Referral program

You receive bonus credits for customers who sign up through your referral link and pay. The current size and term of the bonus are shown in the app. Bonuses for self-referrals or fake accounts are cancelled. We may change the program with 30 days' notice; bonuses already earned stay valid.

6. AI labelling

Videos with an AI presenter carry a visible label and AI metadata. Do not remove them where labelling is required (including the EU) and use the platform's AI-content label when you publish.

7. Rights to the result

You may use your videos for any lawful purpose, including commercially. AI-generated material may not be protected by copyright everywhere, and similar results may be made for others. We show your videos as examples only with your permission.

8. Liability

The Service is provided "as is". As far as the law allows, our liability is limited to what you paid us in the last 12 months, and we are not liable for indirect losses or for content you published without review. Your mandatory consumer rights are not affected.

9. Closing, changes, disputes

You can delete your account at any time in the app. We may suspend an account for serious or repeated breaches. We announce material changes to these Terms by email 30 days in advance. Ukrainian law applies to orders from the ФОП, Florida law to orders from Dowell LLC; consumers keep the protection of the law of their country.
